Friends I want legal opinion from lawyers or from anybody about contract between client and engineer.? Actually my problem is with an engineer who agreed to construct a house according to the contract. That is we both agreed a contract of constructing the house of around 2000 sq.ft. and the agreement also signed. But after completing the work. I asked him to measure the house. But he didn't come instead he said that we won't follow according to the agreement. He added that it may vary. But I didn't let that matter. I brought another engineer to measure the house. He measured it. He said that there is more than 200 sq.ft. deficit is there. I'm really upset about that. When I said this matter to the engineer to whom the contract has been made. He replied me in indecent manner. So dear friends and lawyers I want to know how to approach this matter. Whether I have to go to the "COURT" or to the "ENGINEER ASSOCIATION". I kindly request you all to please help me by giving your valuable advice.
LAWYERS: Is a temporary contract position comparable to a permanent position in reference to the WARN Act? The division of the company I work for has been sold effective as of this upcoming Friday. I have been offered a temporary contract position for 1 month after the close of sale. The new company's contract says I MUST work the contract under it's terms (which allows the period to be shortened or lenghted at their will) to receive the severance package. In reference to the WARN act and/or any other applicable laws or statutes, is a temporary contract position comparable to a good-faith permanent position, at the same rate of pay? I thank anyone / everyone with insight into this issue very much.
Is 113 hours the lawyers spent prosecuting my breach of contract case reasonable? I had to hire an attorney to collect some fees that I earned as an expert witness. The attorneys had to deal with Motion to Change Venue from the Defendant, a Cross-Complaint, full discovery with motions to compel discovery against the Defendant. They also had to participate in a mediation. My attorneys filed a motion for summary judgment and won. In sum they spent 113 hours litigating the case. Is that reasonable?
Breaking a lawyers contract? My family got a lawyer but didnt sign a contract but was paying him just incase we wanted to go through with him, but in the end we decided he wasnt doing a great job he was 3 months behind and just isnt satisfied with his work...we are in the process of looking for another lawyer. When i asked the lawyer to return the money he said he would until we have a contract with anothe lawyer. Can he do that even though WE dont got a contract together? We live in texas if that helps. no we didnt sign a contract for the case he was going to be working on. Hes been our lawyer in the past but this time we dont like how hes handling our situation
I need help with a contract dispute with a former employer. How do lawyers get paid for helping me? I am a Nurse Practitioner and in my previous employment I was to receive a percentage of money generated while I was employed there. After I left, my previous employer refuses to pay me the percentage I am due. If I seek legal help, how does the lawyer make money? Do I pay directly to him/her or does the money come from the amount I would receive from my previous employer? Thanks for any help

Bachelors in Marketing or Management? Intent being to become a Corporate Contract Lawyer in the USA? I am looking to obtain a degree in Law, I wish to know what courses of study I need to pursue which areas to concentration on and the possibility of a minor? I plan to attend a business college beforehand and would also like to know which Law School would help me gain networking as well as in depth study of contract law. I am currently studying business and will declare my major fall of 2008. If you know the answers I would appreciate it. Thank you.
Do law schools offer contract law as a concentration? I don't understand how you become a contract lawyer. All of the law school websites don't list it as a concentration. Are there actually firms that specialize in contract law or is it just something they do on the side?
What happens to a contract with a lawyer if client dies? My father-in-law signed a contract with a lawyer over a dispute with probate of his father's estate. The lawyer froze all assets that were in probate. My father-in-law passed with no will. He had no property and all assets were used to pay for his final expenses. He really has no estate and nothing went to probate. Is the contract still valid? If the contract states that the attorney is still owed money who has to pay for that? How do we get the funds in probate released?
Does a construction contract have to be made by a lawyer? I am the administrative assistant for a construction Company, this is my first time working for a construction company so I constantly have questions. My manager told me to generate a construction contract, to get one from online and then modify it, so i looked online, on google. Everything that came out was about lawyers making up the contracts, and legalizing them, so, when drawing up a contract, do you have to go through a lawyer?
Any lawyers, law students or paralegals here, can you answer this question re: performance contract? I agreed to appear in an indie video. I had an agreement (via email) with the company who filmed it, that I would be paid $500 for being in the video. My original understanding was that this video would be sold as short film. I went to the studio and they had me sign a release prior to making the video. I never got paid. I called the company and they said that, since I failed to perform the scenes as indicated in the contract/release, I violated the contract. (I didn't film one of the action scenes because another actor didn't show up at the set) They also told me that they decided not to try and sell this as part of a short film, and they are just going to scrap the footage instead. I then re-read the release that they had me sign and it was different from the previous agreement mentioned via email. The one I signed said this is for a non-commercial project and that I was doing it without pay. And that it supercedes any previous contract, written or verbal. Am I screwed?
Need a contract lawyer to help me get my final pay from my last employer.? My partner and I were team drivers for a company in Ohio and we live in Florida. We were given names of truck owners that needed drivers to drive for them. We were considered sub-contractors for the owners of the truck and they in turn were contracting with the larger expediting company. We were not paid our final settlement and the owners of the truck are trying to collect money from us for a bunch of unrealistic charges. There are a lot of details to what happened, too much to list here. Can anyone point me in the right direction????
Do I need a lawyer to write up my Lease Purchase Contract? I own a home that I am going to lease to someone for a year and then that person will buy. Do I have to have a lawyer write up the contract or can I do that myself? If I can do it myself, where do I begin? Is there a certain format that I need to use or does that not matter? Thanks.
i need some help regarding legal matters. a contract of sale. any lawyers here who could help me please? a friend bought a parcel of land and has been paying it for months. and she's holding with her the contract of sale as proof of ownership since it hasnt been fully paid, and the land title can only b given after that. now, bec of some personal reasons, she hasn't paid some monthly dues. she was supposed to continue the payments now, but to her surprised, the realty told her that everything is forfeited already. that they already sold her land to someone else. do u think it's legal? they said they sent her notices like mails. but just that. no appearance of their representatives at all. now, they're denying her of that. pls pls help me get an answer to that. thanks.
How much would a lawyer charge to look at a small contract for me? I have a contract an investor is giving me to invest in my company. I want to make sure all he is saying is true but I do not understand everything in the contract due to so much legal terminology. How much would a lawyer charge to simply explain this one page contract to me? I live in St. Louis, Mo.
What (legal) basis gives lawyers the ability to re-use legal contracts originally written by others? By all accounts that I've heard, lawyers (and others) routinely create new contracts based largely upon existing contracts they've come across in one way or another. If a novelist did the same (using others' novels) it would be copyright infringement. I've been told that copyright does not apply to legal documents because they are primarily functional, and not aesthetic, and therefore not subject to copyright. Sounds logical enough, but I'd like something a bit firmer than that - a web page or case law or something that spells it out. Just to be clear, I'm not talking about whether it's wise to use a document in the exact same form as it was used for someone else, but rather, by what legal right/basis someone may use a legal document, that, say, they find on the internet, or in a published case summary or whatnot, and edit and modify that document to their own needs. Again, this seems to be widespread practice, and no one I know has said you CAN'T do it, but I'm just looking for something a little firmer - a provision of the copyright act, or a prior legal ruling, or something that speaks to this more or less directly.
Are there any pro-bono lawyers who can help me end my contract with Sprint? I have been a Sprint customer for almost a year, and have had problems with them for just as long. I ordered 1 phone and they sent me 2 additional phones w/2 additional bills, and when I wouldn't pay, they sent the 2 accounts to a collection agency, to ruin my credit! Luckily they realized their mistake and that problem has been cleared up. But now, I am currently living in Syracuse, NY (since August, in grad school) and my phone doesn't get reception. Every call I make is a dropped call, so they give me $10 credit per month. I can hardly use my phone indoors or outdoors, yet I have to pay $80 a month for a service asked for, which isn't being provided. When I enter my zip code on their website, it says my area has excellent coverage, which is a lie!! Can a pro-bono lawyer please help me??? To MLaw: I never said I deserve free legal help, I simply asked if anyone knew of any pro-bono lawyers, because I can not afford a lawyer. Matt: I purchased the phone way more than 30 days before moving to the area where I am experiencing dropped calls and a poor signal. I agreed to a 2yr contract with Sprint which binds me to pay my monthly bills for 2 years, provided that I am receiving a service. However, whether I am indoors or outdoors, I can't receive a signal good enough to have my calls last more than a minute. When I enter my zip code on Sprint's website, it says I'm located in an area with excellent coverage, but that's not at all the case. Isn't this a breach of contract on their behalf? They're not providing me with service. They give me $10 credit every month because they know they are wrong. This $10 credit is no way a compensation for having to pay about $90 a month for no service.
Can a couple write their own separation contract and have it be legally binding and officially recognized? I'm looking into a legal separation with my spouse, and am wondering if we can write our own contract instead of going through lawyers and the system. We could easily make such a contract now and agree on the terms, but I want to make sure such a contract would be binding in the future. Is this possible? Thanks. I don't want to get a divorce. I just want a *potentially* permanent separation. I want to be separated completely from the marriage, but for personal reasons, I don't want to be officially divorced. After I bought a house, my lawyer did not send me a copy of the house contract? I have been chasing up the house contract to my lawyer/conveyancer for 4 months. At first one of the employee there told me that they don't normally send the contract, they usually keep it in their office but if I want a copy he can send it to me. So i waited but nothing came. I called again then another employee told me that it should be sent a month ago and could not do anything if it was lost in the mail. She said she cannot provide me another copy and told me why do i need the contract anyway. i then spoke to the actual lawyer and told me she will get a copy but it's been more than a month but she's still telling me that its on its way. How important is the house contract. is it worth calling them every week?
How to create contract papers for Interpreting and translating services? I have heard that one has to make a contracts with the hospitals in order to work with them as an interpreter or translator. I have got the fictitious name. Judgment was made against me for a medical bill. Insurance paid amount allowed in contract. what to do? When I went to court i signed a payment agreement they said their was no other way. However, the insurance says that they cannot get more than the allowable amt under contract and that I owe nothing. They also mentioned this to the lawyer for the anesthesia co. Now I don't know what to do. They still want payment and are seeking it from me even after insurance informed lawyer of contract agreement with his client.
When signing a contract with an employer, how well do they stand up in court? How long after hiring an Attorney and signing the contract should you receive a phone call from them? This is an injury/accident lawyer. I met with the investigator and signed the contract they said they'd get right on it, i do think they are a good team of lawyers. My last Lawyer i hired didnt even call me i waited after a 2 weeks and called them , left messages no one ever called me back, kept calling and they gave me a big ole run around then dropped my case after 2 months. I told them to send me my files and all they had was a phone number to the other guys lawyers. So anyways i knows its only been a day but how did your previous experience work when you hired an attorney?
