contracts? explain what collateral warranties are and how the doctrine of privity of contracts and the difficulty or recovering pure economic loss in the law of tort has lead to their increasing use on commercial developments. i have managed to get most of this question dun just thought i would ask a person that has a profession in contracts that could give me advise. thanks to everyone that takes an interest in my problem!!
How does it work for Principal in land contracts? If an agent sells the principals land to them-self and puts self as vendor, then is revoked, Who is the vendor? The agent sold a land contract for the principal, contract states by and between the principal, through his/her power of attorney, then sells principals land to self(POA) and payments to the vendor the POA not the principal. Principal knew nothing of the transaction because POA contracts says POA can sell land without principals knowledge or consent.. Now after revoking the POA Is there anyway that a court would return the principals land to him/her if the agent is found in breach of his/ her fiduciary duty? Need to know if theres hope for principal before contacting an attorney because of high cost of fees. Also if the same agent sold the remaining land to someone else the same way and again made self vendor, what options if any does the principal have to retrieve his/her land back from buyers?

Where does Energy disappear to when a solid contracts when melting? I have a question here that tells me the change in internal energy (U) is positive, Heat supplied (Q) and work done on mass (W) are all positive in the melting of a solid that contracts while melting under constant pressure. I am asked to explain why but i do not know why. I thought that since Q is positive, it is used to weaken the intermolecular bonds (molecular Kinetic energy does not change as temp is constant while melting). Since intermolecular forces are weaken, particles distant increases, potential energy should increase, so U will be positive be positive. But the qns says the solid contracts, meaning potential energy reduces (with no change in Kinetic energy), then U cannot be positive, should be negative. Contracts?...? I signed for a certain gym contract, and a few weeks later chose to change the contract. The sales consultant amended the contract, which I signed, but I have since discovered that the second contract was fraudulent. Do you need to pay money for a new house when exchanging contracts? I am buying a new house off Persimmon and they pay the 5% deposit so I have a 95% mortgage. However at first they wanted 10% of the property upon exchange of contracts. Now they said £500 could be enough. Is this normal practice? From reading other questions on here it seems exchange of contracts is legally binding so why would I need to pay on top of that? If seller backs out of signing contracts can any money be recouped? We had an accepted offer on a home we wanted to purchase. We had the inspection and appraisal done before the contracts were signed. In New York State if the seller backs out after you paid for the appraisal and inspection can you go after the seller for the money invested into the home? By all accounts that I've heard, lawyers (and others) routinely create new contracts based largely upon existing contracts they've come across in one way or another. If a novelist did the same (using others' novels) it would be copyright infringement. I've been told that copyright does not apply to legal documents because they are primarily functional, and not aesthetic, and therefore not subject to copyright. Sounds logical enough, but I'd like something a bit firmer than that - a web page or case law or something that spells it out. Just to be clear, I'm not talking about whether it's wise to use a document in the exact same form as it was used for someone else, but rather, by what legal right/basis someone may use a legal document, that, say, they find on the internet, or in a published case summary or whatnot, and edit and modify that document to their own needs. Again, this seems to be widespread practice, and no one I know has said you CAN'T do it, but I'm just looking for something a little firmer - a provision of the copyright act, or a prior legal ruling, or something that speaks to this more or less directly.

Can the vendor pull out during cooling off period after contracts exchanged? We are currently in our 5 day cooling off period after exchanging contracts on our first home (in Aus). During the cooling off we have had pest and building inspections done and have found problems with some water leakage from the main bathroom which has leaked under the wall into the kitchen area. This will require the kitchen to be pulled out to replace the particle board under the oven and kitchen cupboards. This is our dream home and despite the damage we are still wanting to buy the property. Our conveyancer has mentioned to us that we are able to approach the vendor about a possible rebate on settlement to cover some of the costs associated with the water damage. We have approached the agent and they have told us that the vendor would not be interested in doing this and is even considering removing the property from the market. We have been told by our conveyencer that it is not possible for the vendor to do this as they have already signed a contract agreeing to sell.
